For the purchase of a Havanese puppy.

The description of the puppy is a _____________The puppy that the buyer decides on will be sold for the price of $1,600 males/$1,700 females with a deposit of $500.00 being made on this date ______________. The balance due of $1,100 or $1,200 will be paid at the time of pickup or mailed in by ____________.  After (8 weeks from birth date) if the puppy is not picked up and/or paid in full the seller will have the right to keep the deposit and resell the puppy. If more time is needed for the puppy to recover from the neuter/spay surgery or more time needed with its mother this will be allowed without any boarding charges or penalties to the buyer. However payment must be received by the 8 week birthday. The buyer will get their deposit back or transferred to another puppy if one is available depending on the buyers wishes, if the health or temperament of the chosen puppy were to become unsound before the time of pickup. The buyer will be provided with a current and normal cerf test, ofa patellas on the dam and sire at the time of pickup or before. If any additional screenings are completed buyer will be provided with these as well. If there is a major catastrophe in the life of the buyer (loss of job, divorce, death, etc.) a refund will be given at the discretion of the seller. The deposit will not be refunded if the buyer changes their mind after the date of _______ (6 weeks after birthdate of pup) for reasons other than the ones stated above and after she has approved the pictures of the pups or viewed pups in person.
It is hereby agreed by both parties that the following conditions will be met and that no other warranties or conditions are expressed or implied.
This puppy is sold as a pet and will be neutered/spayed before being transferred to the buyer at the sellers expense. If for some reason our vet feels the pup would not do well with the early neuter/spay we will release the puppy to the buyer and reimburse the buyer upon completion of the surgery up to the amount of $75.00. Or the pup could be brought back to our vet and we will pay for the entire amount of the surgery. If the puppy is released without having the sterilization surgery AKC paper work will be withheld until the surgery is performed and proof of the surgery is mailed back to the seller. This puppy is not being sold as breeding stock or show potential. It will be sold with AKC limited registration with litter registration being available before the pups 6 month birthday. Copies of both parents pedigrees will be provided at pickup or before. A puppy package will be provided that includes: crate, crate mat, leash, collar, training clicker, book called "Puppies for Dummies," shampoo, spray conditioner,  cuddly toy that has the mother's scent, puppy food, biscuits, pigs ears, first monthly flea treatment, first heartworm pill, bitter apple spray, enzyme cleaner, and puppy training information. Dew claws have already been removed and the pup will be micro-chipped for identification purposes. First shots and worm treatment will also have been done by sellers vet on or before 6 weeks. Seller will pay for the kennel cough vaccine. If the puppy is kept until its 10th week seller will pay for the second set of puppy shots.Seller will register the litter with the AKC. Buyer is responsible for individual puppy’s registration with AKC and microchip database.     .                                                                                                                                
The buyer promises to keep the dog in a proper manner. It shall not be kept permanently in a kennel. If the buyer becomes unable to care for the dog at a later date the seller agrees to accept the dog back without questions and without a refund to the buyer. The buyer agrees to not place the dog in a shelter if it becomes unwanted. The seller will try to answer any questions that arise with puppy care and training issues. The seller has raised the pup in a clean environment and with temperament and sound health in mind when doing the breeding. The seller guarantees the health of the pup at the time of pickup to be free of obvious genetic and communicable diseases.
A complete exam by the seller’s vet will be performed before the pup is placed in their new home. A written copy of that form will be provided.  The seller will replace the puppy during the first 2 years if there would be a genetic defect that would cause the death of the puppy. A copy of the autopsy must be provided at the Buyer's expense. If the pup develops cataracts before the 2nd birthday, the pup would be replaced or a $500.00 refund to help cover the cost of any surgery the pup may need. A copy of the cerf test must be provided and the seller reserves the right to have a veterinarian of their choice to perform a second cerf exam. The seller is not responsible for any vet bills incurred during the life of the dog after the date of transfer. The buyer agrees to take the pup to a vet within 48 weekday hours or 72 hours if picked up on a weekend to validate the health guarantee. If upon examination the pup is found to have a genetic or severe life threatening condition/disease puppy will be replaced or money refunded as per buyers wishes. Seller will not replace a puppy that was not cared for and shows obvious evidence upon autopsy of mistreatment, negligence, or abuse as noted by vet performing autopsy after the 48 or 72 hour period but before the first 2 years are over. Failure to take the puppy to the vet in the initial 48 to 72 hour time period will void the health guarantee. 
Buyer releases the seller and their estate from any and all liabilities, and or damages by fault of this dog after the time of sale. These damages include, but are not limited to, destruction of property, and or physical damage to any person or group of people.
 

This contract is made in duplicate and with both parties receiving a copy.

At this time we do not have a full registration sales contract. We are a new kennel and want to fully develop our  blood line before we begin to help others get started with this wonderful breed.
